Suspect in Marine’s fatal stabbing hospitalized, misses court appearance

WILMINGTON — A man arrested over the weekend in the stabbing of a U.S. Marine missed his first court appearance on Tuesday, due to being in the hospital.

Judge Lindsey McKee assigned 47-year-old Davy Spencer a public defender until he can appear back in court to decide his representation. Though the court hearing was set to discuss Spencer’s bond, New Hanover County chief public defender Thomas Woodrum revealed the suspect was in the hospital with a leg injury endured during the early morning hours of April 5.

Spencer has been arrested for second-degree murder and two counts of assault with a deadly weapon with the intent to kill in the death of Lance Corporal Daniel Montano, who was stationed at Camp Lejeune. The 21-year-old was stabbed in the neck following a downtown fight that broke out in the 100 block of North Fourth Street.  

Another person sustained injuries in the stabbing incident, however Montano perished from the assault.

Police arrested Spencer on April 11. Spencer has been arrested before in New Hanover County on drug and assault charges and was sentenced as a habitual felon in 2015.

The New Hanover County District Attorney’s Office told Port City Daily it “could not comment on Spencer’s medical condition, care, or supervision.” It’s unknown when he will appear back in court.
