
WILMINGTON –– District Attorney Ben David announced the state is dropping its first-degree murder and possession of a firearm by a convicted felon charges against Hykeem Durant and Dashon Davis.
Police arrested the two men based on the statement of a material witness, according to the DA’s office. Late Thursday evening, the witness recanted their testimony in a new affidavit.
Without the witness’ testimony, the state has insufficient evidence to continue with the charges.
Durant, then 31, and Davis, then 30, were arrested on Jan. 5 for the murder of Charles Ross Jr., who was killed on October 5, 2020.
Ross was suffering from life-threatening gunshot wounds around 6:25 a.m. that morning when police arrived at the 4100 block of Princess Place Drive. He passed away during surgery at the hospital.
“We will remain open to any additional information coming forward in this investigation,” the DA’s office shared in a Friday news release.
