Motions being heard in former deputy’s appeal of solicitation conviction

A former Brunswick County sheriff’s deputy who was convicted of soliciting sex acts in district court has appealed his case to superior court.

Timothy Paul Caulder, 37, of Shallotte, has appealed his June 3 conviction when Chief District Judge Jerry Jolly found him guilty of two counts of soliciting prostitution of a minor and two counts of soliciting crimes against nature.

His case is set to go to trial Monday in Brunswick County Superior Court, according to court records.

Caulder was arrested in August 2013 after a two-week internal investigation by the sheriff’s office professional standards division, sheriff’s office spokeswoman Emily Flax previously said. He was charged with two counts of soliciting crimes against nature, two counts of soliciting prostitution and willful failure to discharge duties.

Caulder was fired following his arrest, Flax said. He was hired as a detention center deputy in December 2011. He was promoted to a road deputy in August 2012, and earned an annual salary of $36,897.

Jolly found Caulder not guilty on a charge of willful failure to discharge his duties as a sheriff’s deputy. He was sentenced to a 45-day suspended sentence and 18 months of unsupervised release.

After the conviction, James Payne, the attorney representing Caulder in the district court case, withdrew as his attorney. Caulder will be represented by Geoffrey Hosford. Assistant District Attorney Quintin McGee is prosecuting the case.
